Alpha Tau Medical Ltd. (together with its affiliates, hereinafter, we,” “us,” or “Alpha Tau” is a clinical-stage company which focuses on the research, development, and potential commercialization of proprietary technology for the treatment of cancer. In order to fulfill our business purpose, we rely upon data pertaining to patients for populating our clinical trials, and we also seek and maintain information pertaining to individuals for research and business collaborations. We are deeply committed to protecting users’ privacy and personal information which we may receive: from use of our website, in connection with our clinical trial program, or for any other lawful business use. As such, we wish to make you (“users” or “you”) fully aware of how we use and process your information in this privacy policy. By voluntarily providing us with personal information (for example: e-mail address, contact information, and health data) either through our website (the “Site”) or through any other means for a legitimate purpose, you hereby consent to the collection, processing, transfer and use of such information by Alpha Tau pursuant to the terms herein. In addition, you acknowledge and agree that you are not required to provide us with personal information, including by means of responding to our questionnaires, and that any such information has been given of your free will. Any changes or updates to these terms shall be posted on the Site so as to maintain full transparency and access to our privacy policy. If you do not agree with these terms or any changes, then please discontinue your use of the Site and do not provide us with your personal information. How We Collect, Use and Share Your Information

In the course of populating our clinical trials with suitable patients who meet the various eligibility criteria of a given study, we may ask specific, personal, medical questions relating to an individual’s cancer diagnosis. In doing so, we use a system for compiling information called Jotform, which undertakes to protect users’ privacy in its privacy policy at https://www.jotform.com/privacy/. We may also seek, with your explicit consent, personal contact information in order to follow up with respect to your eligibility as a clinical trial candidate to ask additional qualifying questions and to coordinate subsequent steps towards participation in the trial, if applicable. You may also provide such personal health and contact information at your own discretion, including by means of email, telephone or by contacting us through the Site. Transcripts and recordings of phone calls to determine eligibility and for additional follow-up are managed by Intermedia.net Inc, which represents that its “services are designed to meet the privacy and security requirements for Protected Health Information (PHI)” whose “policies, procedures, technologies and services are audited by a third-party to validate conformance with HIPAA privacy and security requirements”. Such transcripts and recordings may be accessed for an indefinite duration of time by select members of our team for quality assurance and other legitimate business purposes.

You may voluntarily sign up to our mailing list to be notified about future trials by clicking on the button “Subscribe to our Newsletter” on https://www.alphatau.com/news. The subscription is operated by a marketing platform, MailChimp, which undertakes to be GDPR compliant at https://mailchimp.com/gdpr/. For this service, upon receiving your explicit consent, we will obtain your e-mail address, your first name and your last name (not required), which we use only for the purpose of sending you the information you requested or other news items pertaining to Alpha Tau from time to time. You may of course be able to unsubscribe from such mailing list at any time, either by clicking on the unsubscribe link included in all newsletters, or by contacting us at https://www.alphatau.com/contact.

All data collected by Alpha Tau for the purpose of performing clinical trials or for communicating with people who express interest in Alpha Tau is processed internally. More specifically, access to such information is strictly limited to select Alpha Tau team members, and is furthermore strictly limited for the legitimate purposes set forth in this policy. In the event a user might participate in a clinical trial, then we will share the user’s personal health information which was provided in response to our questionnaires only with the relevant medical institutions which are conducting the clinical trials. We may also share such data with a contract research organization (CRO) which provides support in conducting the trial, but we will not make any use of such user’s data during the course of a trial, in order to maintain the user’s privacy, and in order to uphold the international standards of Good Clinical Practice (GCP). When we do share information with these healthcare professionals and CROs, they may provide users with an information leaflet containing an informed consent form which sets out the required information about the clinical trial and a separate privacy notice detailing how they will use their information, and may otherwise contact users directly for the legitimate purpose of clinical trial participation. Please note that Alpha Tau does not control who will ultimately participate in a clinical trial. Additionally, we may share your data only where necessary for us to comply with any legal obligations to which we are subject, to exercise our legal rights, or to protect ourselves or any other person when reasonably required. Alpha Tau does not sell, trade or rent your personal information to any third party.

We will also use and store your data for the purpose of analytics and optimization of our outreach, but we strive to ensure that this is done on an anonymized basis and that it is performed by a limited team. Our cyber and privacy team routinely meet and perform audits of the relevant team members’ practices and devices.

How We Store and Secure Your Data

Information regarding users will be maintained, processed and stored by Alpha Tau and our authorized affiliates in secured cloud storage provided by third-party service providers, which maintain such facilities worldwide and with whom we ensure that they represent to maintain industry-standard security credentials. Our servers, located in Israel, Europe and North America, hosted by Microsoft, contain firewalls and anti-virus technology that reflects industry standards in order to secure your data against loss, unauthorized access, or improper use. Likewise, we employ Secure Sockets Layer (SSL) encryption technology to protect your personal data sent to us through the Site or otherwise provided to us.

However, we do not and cannot guarantee that unauthorized access will never occur. No Internet or Wi-Fi transmission can ever be 100% guaranteed as secure, and so we encourage you to take care when disclosing personal data online, and to use readily available tools, such as Internet firewalls, anti-virus and anti-spyware software and similar technologies to protect yourself online.

We intend to keep a record of our communication with you for legal compliance and for legitimate internal purposes on our secured servers. Please be further advised that we may continue to store your information regardless of: (a) whether you were eligible or ineligible for a given clinical trial, (b) whether or not you participated in, entered or completed a given clinical trial; (c) the results of a given clinical trial, or (d) whether a clinical trial was discontinued for any reason. With respect to users who are potential or actual business or research partners, we may store your personal contact information regardless of whether a collaboration is pursued or completed.  In any event, we shall only store your information when so justified on a lawful basis. More specifically, we may retain your contact and personal information for a reasonable period and may contact you in the event of future clinical trial, treatment or collaboration opportunities which may be relevant based upon your previous correspondences. We will of course delete all such correspondences and cease all communications, where legally and practically feasible, upon your written request, by contacting us at the address provided below.  We may also continue to store anonymized, aggregated data for analytic purposes, and will not share such data except with specific vendors who obligate themselves to maintain the same standards of data privacy as more detailed below.

How We Monitor Your Use of the Site


Alpha Tau uses “cookies” which are small pieces of information that are stored by your browser on your device’s hard drive, in order to provide features designed to enhance the service we provide, such as by making clinical trial recruitment more efficient and targeted, and by designing trial protocols to best address relevant areas of need. Our cookies do not contain any personally identifying information. Most web browsers automatically accept cookies, but you can usually change your browser to remove them. Even without a cookie, you can still use most of the features on the Site, including signing up for studies or our newsletter.

 

In addition, we use third-party cookies for Site usage analytics purposes such as Google Analytics. The data shared with these third parties do not include personally identifiable information. Our Use of Data in Connection with General Corporate Compliance  and Whistleblowing

 

Alpha Tau maintains an environment of high integrity and corporate compliance. To that end, we have adopted policies which govern how potential instances of impropriety or non-compliance are handled. Such policies include the implementation of processes which encourage allegations of financial or accounting impropriety to be made as safely and anonymously as the applicable law and circumstances allow. Moreover, we will process, store, and transfer data relating to the complaint securely and confidentially, and only to the extent and duration necessary to fulfill our regulatory and legal requirements.

 

Complaints made from the European Union or the UK, or that relate to an alleged incident that took place in the European Union or the UK, shall be handled with specific sensitivity to the applicable data protection rules; for example, access to details and other data pertaining to such complaints, including personal data and special category data such as ethnicity, religion, or health, of a reporting person, shall be strictly limited to those for whom there is a lawful basis to grant such access as is necessary for a prompt, thorough, and fair inquiry and response. Transfers of such data, whether to Alpha Tau personnel or to regulatory or governmental authorities if so required, shall be likewise limited. Further, such data shall be stored only for the requisite retention period pursuant to applicable law.  

 

Reporting persons have the fullest rights under data protection laws to access and obtain a copy of personal data stored in connection with a complaint, and to require our modification, erasure and/or restriction of processing of such data. Of course, under certain circumstances, we may be required by law to disclose a reporting person’s identity, in which case we will do so with the utmost care and regard for the data protection laws.
